These Terms of Service ("Terms") govern your access to and use of marql, operated by marql ("we", "us", "our"). By using the platform, you agree to these Terms. The platform is intended exclusively for legal entities (companies, retail and HoReCa network operators) and their authorised representatives. Use by individual consumers acting outside their trade or profession is not permitted.

1. The Service

marql is a business intelligence and operations platform for retail and HoReCa chains. We provide dashboards, analytics, integrations, and ops tools accessible via platform.marql.one.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials. You may not share your account with others or use the platform for unauthorized purposes.

3. Subscription and Payment

marql offers guided setup and paid subscription plans. Pricing is available at marql.one/pricing. Subscriptions are billed in advance. Failure to pay may result in suspension of access.

4. Your Data

You retain ownership of all business data you input or connect to marql. By using our platform, you grant us a limited license to process your data solely to provide the service. We do not sell or share your business data with third parties.

5. Acceptable Use

You agree not to:

Use the platform for any illegal or unauthorized purpose
Attempt to gain unauthorized access to any part of the platform
Reverse engineer or copy the platform
Interfere with or disrupt the platform's infrastructure

6. Availability and Uptime

We aim for high availability but do not guarantee uninterrupted service. We are not liable for losses resulting from downtime, data loss, or service interruptions beyond our control.

7. Limitation of Liability

To the maximum extent permitted by law, marql shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

8. Termination

Either party may terminate the agreement at any time. Upon termination, your access will be revoked and your data will be deleted within 30 days unless you request an export.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of Romania. Disputes shall be resolved in the courts of Bucharest.

12. Artificial Intelligence Features

In accordance with Article 50 of Regulation (EU) 2024/1689 (EU AI Act), applicable from 2 August 2025, we inform you that the marql platform includes an AI Copilot feature that uses large language models (LLMs) to generate analytical responses based on your business data.

The AI Copilot is an AI system that generates responses automatically — you are interacting with artificial intelligence, not a human operator.
AI-generated content may be inaccurate or incomplete. You should verify AI outputs before making business decisions based on them.
marql is not liable for decisions made solely on the basis of AI-generated output.
The AI Copilot processes only the business operational data connected to your marql account. Your data is not used to train AI models.
